Proving Workplace Bias: Understanding EEOC Pretext
Employees who experience unfair treatment at work often face one of the biggest challenges in employment law: proving that an employer's stated reason for an adverse employment decision is not the real reason. In many discrimination cases, employers provide a legitimate business explanation for actions such as termination, demotion, or failure to promote. However, if that explanation is false or misleading and is used to hide unlawful discrimination, it may be considered a EEOC Pretext for Discrimination.
